Adoption & Health Contract
Mutual Promises to Produce & Maintain Health & Vitality
Annette Wade (hereinafter referred to as "Breeder") hereby certifies that this puppy has been kept on a preventative program intended to minimize exposure to canine parasites (both ecto and internal parasites) and infectious disease and will have been given phophylactic treatments such as vaccinations and antihelminth medications at the sole discretion of the Breeder, according to the individual puppy, litter, time of year and current recommendations by various veterinary and canine health experts.
It is the sole responsibility of the Purchaser to discuss and adopt health protective measures with a qualified and trusted veterinary professional after the Purchaser assumes physical custody of the puppy. Breeder is not responsible for any veterinary costs acquired by Purchaser after the puppy leaves the physical custody of the Breeder.
Purchaser understands that the puppy will require regular puppy examinations immediately after adoption and following a standard puppy exam protocol which can be set in place by a qualified veterinarian of the Purchaser's choosing. If the puppy is not kept up to date on necessary wellness examinations and appropriate phrophylactic care this contract is void.
Purchaser is hereby informed that, until the “puppy series” of vaccinations is completed, the puppy may not have immunity to many potentially life threatening diseases. Blood titer tests are required to ensure vaccine efficacy and Breeder recommends such tests to Purchaser, but does not require them. Purchaser is advised not to bring the puppy into canine communal areas (such as dog parks, pet stores, etc.) until vaccination series are completed and/or with a veterinarian’s consent.
Purchaser agrees to have the puppy examined, at the Purchaser’s expense, by a licensed veterinarian within two (2) days from the date Purchaser assumes physical custody of the puppy. If the puppy is not seen within two (2) days by a licensed veterinarian this contract is void. Breeder requires written proof from a licensed veterinary care facility that the puppy was originally seen within 2 business days of the puppy leaving the physical care of Breeder. Such proof must be submitted to Breeder on veterinary letterhead within 48 hours of veterinary examination.
Breeder guarantees the puppy to be free of any life-threatening disease at the time the Purchaser takes physical custody of the puppy. Breeder further guarantees the puppy to be free of any life-threatening congenital and genetic defects for one year from the puppy's date of birth. If, upon examination by a licensed veterinarian, the puppy is found to have a life-threatening health defect Purchaser agrees to have the veterinarian document this condition with a written, signed statement clearly stating the symptoms, exact problem, severity, and any tests that have been done to provide evidence of the health condition. The Purchaser will then notify the Breeder of the situation within 24 hours of such a diagnosis.
In the unfortunate and heart-breaking event the puppy has a life-threatening disease that is confirmed by veterinary professionals to have been acquired while in the physical custody of the Breeder or a life-threatening congenital or genetic health defect within one-year of the date of the puppy's birth the Breeder will replace the puppy with another of equitable value, temperament, and size (gender, coat type and color may be different from original puppy) and the affected puppy will be returned to the Breeder where he/she can receive adequate medical care and attention. Puppy must be returned to the Breeder within 24 hours of such a diagnosis in order to recieve medical care. Breeder is not responsible for costs associated with transporting the puppy to Breeder's location.
If there is no puppy immediately available to replace the sick puppy, as it must be understood that the Breeder does not have litters available at all times, it is agreeable under these conditions to issue a contract agreeing to give the Purchaser a puppy of equitable value, temperament, and size (gender, coat type and color may be different from original puppy), of the Breeder's choice, from a future litter within nine months' time.
Purchaser may, however, choose to keep the puppy and accept all financial responsibilities, with the Purchaser understanding that no refunds will be given, however the Breeder may choose to donate a portion of the original adoption fee directly to veterinary professionals to aid in any veterinary costs related to treating the condition. Such a donation is made at the full discretion of the Breeder.
Breeder also reserves the right to have the Breeder's veterinarian(s) evaluate the condition (at the Breeder's expense) following the receipt of the animal before any replacement or donation is made. Purchaser is responsible for all transportation costs to return the puppy and Breeder is not responsible for any veterinary expenses related to the certification that the animal is unfit or otherwise (except in the case of veterinary expenses incurred after the puppy is returned to Breeder’s custody).
If a puppy is to be returned the puppy must be accompanied by a written statement from a licensed veterinarian indicating that all shots are up to date, the puppy/dog has had a negative fecal within 30 days, the puppy/dog has had a negative heartworm test or has been on preventative medication, and that the puppy/dog appears to have been well cared for. This is to ensure the safety of the Breeder's other dogs, rescues and puppies at the kennel.
If this is impossible arrangements must be made to have the puppy brought directly to the Breeder's veterinarian to have these health clearances at the Purchaser's expense, otherwise the puppy may be returned to the Breeder (directly at the veterinarian's hospital) with no expectation of a replacement or refund.
If the return of the puppy is within one week (7 days) of original transfer of custody from Breeder to Purchaser then these certifications will not be required.
If the puppy dies within one year from the date of birth a necropsy must be performed to determine if the reason was genetic, congenital, or due to other causes. This information is invaluable, both to the Breeder and the Purchaser. The Purchaser will be responsible for any charges and in no way is the Breeder responsible for payment of this exam or any other medical bills. Many veterinarians will perform a necropsy free of charge. The Purchaser is encouraged to work together with the Breeder to locate an acceptable veterinarian.
In the awful, albeit unlikely event that the puppy dies within one year date of birth and a necropsy shows that the result was an undiagnosed congenital or genetic defect the Purchaser will be entitled to recieve a replacement puppy of equitable value, temperament, and size (gender, coat type and color may be different from original puppy) from any current or upcoming litter.
Purchaser understands that the following slight congenital defects are not considered serious or life threatening and therefore are not covered by this guarantee: umbilical hernia, inguinal hernia, cherry eye, undescended testes, under bite or over bite, grade 1-2 heart murmur and grade 1-3 luxating patella(s).
This guarantee also does not cover hypoglycemia, coccidiosis, kennel cough, giardia, mites, ticks, ringworm or ear infections once the puppy has left the Breeder hands due to the fact that these conditions can be easily picked up during travel, in the puppy’s new home or yard, or as a result of stress, improper handling, and/or inattentive/inexperienced caregiving.
The Breeder does guarantee the puppy to be free from any major physical infestation or infection upon adoption. Upon adoption Purchaser agrees to physically inspect puppy in presence of Breeder to address any concerns Purchaser may have with puppy physically. Breeder promises not to adopt out any puppy showing any physical sign of illness, serious stress or infestation. Breeder also guarantees the health and cleanliness (and lack of preventable/treatable infestation and infection) of the home and yard where puppies are housed prior to adoption.
There is no way to predict how a puppy will cope with the change of a new home and owners. It is the responsibility of the Purchaser to carefully and slowly transition the puppy to any change in diet and to provide the most stress free transition to their new living environment and ownership as possible. Internal parasites, including various intestinal "worms", coccidia, and giardia are a common cause of problems in all breeds of young puppies. Even though your puppy has been de-wormed before you adopted him/her, please understand that puppy wormers are only effective against adult worms and do not kill larva that can be easily picked up by your puppy. Young puppies need frequent de-worming to protect them as they develop. It is the responsibility of the Purchaser to continue any necessary de-worming of their puppy under the care of a licensed veterinarian.
The Breeder assumes no responsibility of puppy after the puppy leaves the sellers premises for medical expenses, disease, mortality unrelated to breeding practices, landlord disapproval, allergies, shedding, personality, training, disagreement of family members, or any other reasons not relating to health, and no refunds will be given. However should Buyer wish to return the puppy for any reason he/she may do so, understanding that no refund will be given. Under no circumstances is the Breeder responsible for any veterinarian bills or shipping expenses incurred with the puppy after time of sale. In the case of any legal dispute between parties the buyer is responsible for any and all legal fees incurred on the part of Breeder. And Buyer agrees that all legal disputes shall be conducted in the home state and county of Eden Orchards, the Breeder, at the time the dispute requires legal resolution. Furthermore the Buyer and Breeder both agree to attempt to mediate and resolve any unfortunate conflict with a mutually agreeable compromise and utilize courts as a last resort in an effort to prevent unnecessary expenses and unhappiness on the part of the Buyer and Breeder alike. The Buyer should be aware that the satisfaction of all buyers is of utmost importance to the Breeder and conflict resolution is always a better alternative in these sometimes unavoidable and unfortunate circumstances.
The Buyer understands that he/she/they may contact the Breeder for advice or guidance at any time during the puppy’s lifetime or during ownership of any other dog obtained from any other location. Seller is available for any questions or behavioral concerns the Buyer might ever have. The Buyer may, at any point, call and email or otherwise contact the seller, and is also urged to maintain a relationship with a trusted and knowledgeable veterinarian for the lifetime of any pet ownership. Buyer understands that as Cockapoos, especially puppies, are small animals they can be overwhelmed by illnesses extremely quickly, and therefore should be rushed to a veterinarian at the first sign of serious illness.
Buyers Promise: Buyer agrees to read all puppy health materials provided by seller in “New Puppy Package” via email or in hard-copy format by request, prior to adoption date and, most importantly, agrees to provide adequate care and affection for their new companion for the duration of their little furry doggie life (except in the event of tragic and unforeseeable events; please refer to the re-homing agreement). Adequate care includes, but is not limited to, proper diet and nutrition fed with adequate frequency, proper medical care (as determined by Buyer; advised by or in conjunction with a licensed veterinarian of Buyer's choice), proper housing including basic comforts, and regular grooming and hygienic maintenance. Adequate affection includes, but is not limited to, proper obedience training, regular mental stimulation, regular exercise, and proper socialization with humans.
Buyer promises to notify Breeder in the event of any serious medical condition at any point in the dog's life to help the Breeder ensure the best possible health of all dogs produced; past, present and future.

Re-homing Agreement
Should the buyer decide at any time during the life of the puppy/dog that the buyer no longer wishes to retain ownership of the dog for any reason and the buyer is unable to obtain a suitable new home for the puppy/dog, the buyer will return the puppy/dog to the Breeder with no expectation of any refund. The buyer agrees to never, under any circumstance, allow the puppy/dog to be placed into an animal shelter or rescue. This contract is non-transferable.
Spay/Neuter Agreement
Buyer agrees to have the adopted puppy spayed/neutered between the ages of 5-8 months, at sole expense of the buyer. Buyer agrees to mail or email proof of puppy/dog sterilization within that window of time. Adopted puppies are not to be used for breeding purposes of any kind, unless there is a previous written arrangement and any breeding quality pup is temperament, DNA and health tested and matched with an appropriate partner in conjunction with Eden Orchards' breeding plan. Should any litters be conceived in violation of this contract the buyer agrees to prevent any of the puppies from being placed into animal shelters/rescues. Should any litters be conceived in violation of this contract Eden Orchards is entitled to monetary damages and buyer is responsible for all legal fees incurred by both Breeder and buyer.
